UK Environmental Law - Waste

Companies must adhere to a strict duty of care under the Environmental Protection Act 1990, requiring them to securely store, transport, and dispose of all controlled waste using licensed carriers.
Key legal requirements include separating recyclables (metal, plastic, paper, glass), using licensed waste transfer stations, and retaining signed waste transfer notes for at least two years
New 2025 Regulations: As of April 2025, many businesses in England must also ensure separate food waste collections

Duty of Care (EPA 1990): All businesses are legally responsible for their waste from production to final disposal.
Licensed Waste Carriers: Waste must only be transferred to authorised, licensed waste carriers.
Waste Transfer Notes (WTNs): A signed document must accompany every transfer of waste, recording what the waste is, who is collecting it, and where it is going.
