UK Environmental Law - UK BAT
 

Following Brexit, the UK is establishing its own Best Available Techniques (BAT) regime, moving away from EU processes to set independent standards for industrial emissions.
A UK BAT advisory group (government, industry, NGOs) has been established to guide this process, with formal draft BAT conclusions (BATC) for sectors like galvanising expected to be finalised around 2025/2026

 

Key Aspects of the UK BAT Framework:Independent Process: The UK government, along with Scotland, Wales, and DAERA, now determines BATs, aiming for consistency while allowing for national differences.
Advisory Group: A stakeholder group reviews the system's operation and provides feedback on calls for evidence. Status of Documents: Existing EU BAT reference documents (BREFs) continue to apply until replaced by new UK BAT conclusions. Drafting & Consultation: New BAT conclusions are published as drafts for public consultation before becoming Statutory Instruments for environmental permits. Future Focus: The regime focuses on updating standards for various industrial sectors to align with UK environmental goals
